These Official Rules govern the conduct of the raffle and are binding on everyone who acquires a raffle ticket and/or who is named on a raffle ticket. The FORT MYERS AMATEUR RADIO CLUB INC. Raffle is a fundraising activity in support of FORT MYERS AMATEUR RADIO CLUB INC., which is a not for profit, 501(c)(3) charitable organization, with a company address of • P.O. BOX 061183 FORT MYERS , Florida 33906-1183.
The Fort Myers Amateur Radio Club, founded in 1959, endeavors to further the hobby of ham radio. The Club provides educational opportunities for new hams and those wishing to upgrade their skills in amateur radio. Proceeds from this event will benefit FORT MYERS AMATEUR RADIO CLUB INC. ‘s goal to purchase and outfit an Mobile Communications trailer for use during natural disasters and in support of the Lee County Emergency Management Programs.
THE PRIZES:
Each ticket holder wins entry into the FORT MYERS AMATEUR RADIO CLUB Inc. Raffle. The drawing will occur at approximately 2p.m. On JAN 20, 2024. Three raffle prize winners ( 1st , 2nd and 3rd prize) will be chosen from the ticket holders. The raffle prize winners shall win a prize purchased with funds from fees and contributions to FORT MYERS AMATEUR RADIO CLUB Inc.
THERE SHALL BE NO SUBSTITUTIONS; NO CASH REFUNDS; AND NO CASH OR OTHER SUBSTITUTIONS. The raffle prize winners assumes and must pay all fees and charges (including, but not limited to, local, state and federal taxes) when the prize is transferred to the winner. In addition, all costs of ownership, are the raffle prize winner’s sole responsibility. The winner should consult with his/her financial adviser.
FORT MYERS AMATEUR RADIO CLUB Inc. assumes no responsibility for a prize winner’s tax obligations and suggests you consult your tax adviser. FORT MYERS AMATEUR RADIO CLUB Inc. will file a form W2g with the Internal Revenue Service to report the value of the prize won. The winner will also receive a copy of the IRS Form W2g form reporting the value of the raffle prize and the amount of taxes withheld. However, FORT MYERS AMATEUR RADIO CLUB Inc.makes no guarantee that the Internal Revenue Service (IRS) will accept any stated value of the PRIZE FOR the purpose of determining any income tax that may be due from the winner. FORT MYERS AMATEUR RADIO CLUB Inc. takes no responsibility for any tax liabilities. The raffle prize winner is strongly advised to seek professional legal and tax advice. Award of the raffle prize could have material adverse consequences on the raffle prize winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters. The IRS has taken the position that purchases of raffle tickets are not tax-deductible contributions.
This offer is void where prohibited by law and all federal, state and local laws and regulations apply. The winner must have proper identification when claiming the prize (a valid state driver’s license OR OTHER PHOTO ID). FORT MYERS AMATEUR RADIO CLUB Inc. is not responsible for the prize’s quality nor shall it have any responsibility once the prize has been conveyed or delivered to the winner. It is the winner’s responsibility to make arrangements to pick up or have the prize delivered.
Eligibility:
Only those 18 years of age and older at time of donation are eligible to participate and enter. Only ticket holders with validly obtained tickets are eligible to participate in the Raffle. FORT MYERS AMATEUR RADIO CLUB Inc. reserves the right to disqualify any entrant for violation of these Official Rules, any applicable laws, or who makes any misrepresentations relative to this drawing of chance. Raffle tickets may not be acquired in the name of a business, trust, corporation, or other entity, or wherever prohibited by applicable law. Prize winners may be required to sign an affidavit of eligibility. Drawing will be conducted by an independent individual unrelated to the foregoing.
Entry and Tickets:
The suggested minimum donation is $1 per ticket. Limit of one ticket per donation. The $1 is payable to FORT MYERS AMATEUR RADIO CLUB Inc. There is no maximum number of tickets to be sold. Ticket sales will cease at 1:55 p.m. EST on JANUARY 20, 2024. Any requests and donations received following the cut off dates will be returned to the sender. NO OTHER REFUNDS AVAILABLE. FORT MYERS AMATEUR RADIO CLUB Inc. assumes no responsibility for lost, late,misdirected, or non-delivered mail or other failure to deliver tickets prior to any deadline. FORT MYERS AMATEUR RADIO CLUB Inc. reserves the right to limit the number of tickets distributed to each person. The $1 suggested donation for the FORT MYERS AMATEUR RADIO CLUB Inc. Raffle may be made:
1) In person before the event. 2) By mail. Send a request for a ticket, with donation to FORT MYERS AMATEUR RADIO CLUB Inc. P.O. BOX 061183 FORT MYERS, Fl. 33906-1183 USA No purchase or contribution is necessary to participate in the Raffle. To enter without a donation, send a letter stating that you wish to obtain a “no donation” entry with your name, address and phone number and a stamped, self-addressed envelope to: Fort Myers Amateur Radio Club Inc. P.O. BOX 061183 FORT MYERS, Florida 33906-1183 USA . Only one “no donation” entry per household. When a raffle ticket request is received , FORT MYERS AMATEUR RADIO CLUB Inc. will complete the raffle ticket by filling in the name, address and phone number of the requester.
3) At the event.
Any returned and canceled checks will automatically disqualify the ticket holder from winning the raffle prize.

Selection of Winner:
The raffle drawing for the FORT MYERS AMATEUR RADIO CLUB Inc. Raffle prizes will be held on Saturday, JAN 20, 2024, drawn at random at approximately 2p.m. at the HAMFEST conducted at THE “Florida SouthWestern State  College ”,Bldg U 8099 COLLEGE  PARKWAY, 33919 Fort Myers, Fl. With the exception of this and all other dates stated in these rules, the date may be extended in the FORT MYERS AMATEUR RADIO CLUB Inc.’s absolute discretion. The winner does not need to be present to win. In order for the raffle prize winner to receive the raffle prize (subject to the other provisions in these rules), if not present at the drawing; the raffle prize winner MAY elect to receive the prize via USPS mailing or personal delivery within the local area. The winner will be responsible for picking up or making arrangements for delivery, and paying all taxes associated with the raffle prize.
General Terms and Conditions:
By participating in this raffle, all ticket purchasers and everyone named on a raffle ticket accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here and (2) that their name and/or likeness may be disclosed to and used by the news media and may otherwise be used by FORT MYERS AMATEUR RADIO CLUB Inc. for publicity purposes and the raffle prize winner to be published in area newspapers or other media including television, radio, web and print. The raffle prize winner will be published on FORT MYERS AMATEUR RADIO CLUB Inc.’s Website. The name of the winner may be obtained by sending a written request plus a self-addressed, stamped envelope to provided above. By participating in this raffle, each participant releases FORT MYERS AMATEUR RADIO CLUB Inc. and each of their respective directors, officers, and agents from any and all liability for injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold FORT MYERS AMATEUR RADIO CLUB Inc. and each of their respective directors, officers, and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize. No purchase or contribution is necessary to participate in the Raffle.
Refunds:
All raffle ticket acquisitions are final. No refunds will be made except as to any ticket requests with verified donations received after ticket sales cease. No other refunds are available. FORT MYERS AMATEUR RADIO CLUB Inc. assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A participant’s sole and exclusive remedy for FORT MYERS AMATEUR RADIO CLUB Inc.’s breach shall be limited to the return of the donation paid for his or her raffle ticket(s). In no event shall FORT MYERS AMATEUR RADIO CLUB Inc. or their respective directors, officers, members, committee members, agents, contractors, advisers, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.
DISCLAIMER OF ALL OTHER REPRESENTATIONS and WARRANTIES:
THE RAFFLE PRIZES WILL BE TRANSFERRED TO THE RAFFLE PRIZE WINNERS IN “AS IS, WHERE IS” CONDITION BY FORT MYERS AMATEUR RADIO CLUB Inc. FORT MYERS AMATEUR RADIO CLUB Inc. DOES NOT PROVIDE ANY GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, IN CONNECTION
WITH THE PRIZE.
FORT MYERS AMATEUR RADIO CLUB Inc. ACCEPTS NO LIABILITY OR RESPONSIBILITY REGARDING THE MANUFACTURING OR CONDITION OF THE PRIZE. NO WARRANTIES, EXPRESS OR IMPLIED, ARE MADE OR OFFERED BY FORT MYERS AMATEUR RADIO CLUB Inc. THERE ARE NO REPRESENTATIONS OR WARRANTIES OTHER THAN AS SET FORTH IN THESE OFFICIAL RULES AND REGULATIONS.
FORT MYERS AMATEUR RADIO CLUB Inc. DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE RAFFLE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. A RAFFLE PARTICIPANT’S SOLE AND EXCLUSIVE REMEDY FOR FORT MYERS AMATEUR RADIO CLUB Inc.’S BREACH SHALL BE LIMITED TO THE RETURN OF THE DONATION PAID FOR HIS OR HER RAFFLE TICKET(S). IN NO EVENT SHALL FORT MYERS AMATEUR RADIO CLUB Inc. BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF FORT MYERS AMATEUR RADIO CLUB Inc. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ANY CLAIM OR DISPUTE AGAINST FORT MYERS AMATEUR RADIO CLUB Inc. WITH RESPECT TO THE RAFFLE MUST BE BROUGHT WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ARISES. DISCLOSURE: A COPY OF THE OFFICIAL REGISTRATION AND FINANCIAL INFORMATION MAY BE OBTAINED FROM THE DIVISION OF CONSUMER SERVICES BY CALLING TOLL FREE WITHIN THE STATE 1-800-435-7352.
