These Official Rules govern the conduct of the Door Prize Drawings and are binding on everyone who acquires a Door Prize ticket and/or who is named on a Door Prize ticket. The FORT MYERS AMATEUR RADIO CLUB INC. Door Prize Drawing is an activity of the 2022 Hamfest conducted by FORT MYERS AMATEUR RADIO CLUB INC., which is a not for profit, 501(c)(3) charitable organization, with a company address of • P.O. BOX 061183 FORT MYERS , Florida 33906-1183.

The Fort Myers Amateur Radio Club, founded in 1959, endeavors to further the hobby of ham radio. The Club provides educational opportunities for new hams and those wishing to upgrade their skills in amateur radio.  Proceeds from this event will benefit FORT MYERS AMATEUR RADIO CLUB INC. ‘s goal to purchase and outfit an Emergency Communications trailer for use during natural disasters and in support of the Lee County Emergency Management Programs.

THE PRIZES:
Each Admission ticket holder is given free entry into the  FORT MYERS AMATEUR RADIO CLUB Inc. Door Prize Drawing. The drawings will occur at hourly intervals beginning at 1:00 pm an ceasing at 4:00pm  on Jan 21, 2022 and beginning again at 0900 am until 2:00pm on JAN 12, 2022.   There will be an additional Door Prize drawing conducted at 2p.m. on Jan. 22, 2022 to select the recipients of the  three top Door Prizes.   Prize winners ( Grand Prize , 2nd  and 3rd prize) will be chosen from the ticket holders.  The Door Prize prize winners shall win a prize purchased with funds from fees and contributions  or donated to FORT MYERS AMATEUR RADIO CLUB Inc. at no charge to the Door Prize participants.

THERE SHALL BE NO SUBSTITUTIONS; NO CASH REFUNDS; AND NO CASH OR OTHER SUBSTITUTIONS.  Each Door Prize winner assumes and must pay all fees and charges (including, but not limited to, local, state and federal taxes) when the prize is transferred to the winner. In addition, all costs of ownership, are the Door Prize winner’s sole responsibility. The winner should consult with his/her financial adviser. FORT MYERS AMATEUR RADIO CLUB Inc. assumes no responsibility for a prize winner’s tax obligations and suggests you consult your tax adviser.  FORT MYERS AMATEUR RADIO CLUB Inc. will file a form W2g with the Internal Revenue Service to report the value of the prize won. The winner will also receive a copy of the IRS Form W2g form reporting the value of the raffle prize and the amount of taxes withheld. However,  FORT MYERS AMATEUR RADIO CLUB Inc.makes no guarantee that the Internal Revenue Service (IRS) will accept any stated value of the PRIZE FOR the purpose of determining any income tax that may be due from the winner. FORT MYERS AMATEUR RADIO CLUB Inc. takes no responsibility for any tax liabilities. The Door Prize winner is strongly advised to seek professional legal and tax advice.  Award of the Door Prize could have material adverse consequences on the Door prize winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters. .

This offer is void where prohibited by law and all federal, state and local laws and regulations apply. The winner must have proper identification when claiming the prize (a valid state driver’s license OR OTHER PHOTO ID).  FORT MYERS AMATEUR RADIO CLUB Inc. is not responsible for the prize’s quality nor shall it have any responsibility once the prize has been conveyed or delivered to the winner. It is the winner’s responsibility to make arrangements to pick up or have the prize delivered.

Eligibility:

Only those 18 years of age and older at time of donation are eligible to participate and enter.  Only ticket holders with validly obtained Addmission tickets are eligible to participate in the Door Prize Drawings. FORT MYERS AMATEUR RADIO CLUB Inc. reserves the right to disqualify any entrant for violation of these Official Rules, any applicable laws, or who makes any misrepresentations relative to this drawing . Door Prize tickets may not be acquired in the name of a business, trust, corporation, or other entity, or wherever prohibited by applicable law. Prize winners may be required to sign an affidavit of eligibility. Drawing will be conducted by an independent individual unrelated to the foregoing.

Entry and Tickets:

NO  REFUNDS AVAILABLE.  FORT MYERS AMATEUR RADIO CLUB Inc. assumes no responsibility for lost, late, misdirected, or non-delivered mail or other failure to deliver tickets prior to any deadline. FORT MYERS AMATEUR RADIO CLUB Inc. reserves the right to limit the number of tickets distributed to each person. The Admission Ticket for the FORT MYERS AMATEUR RADIO CLUB Inc. may be obtained:

1) In person before the event.

2) By mail.   Send a request for an Admission ticket, with the appropriate payment, to FORT MYERS AMATEUR RADIO CLUB Inc.  P.O. BOX 061183 FORT MYERS, Fl. 33906-1183 USA .   You must include your name, address and phone number and a stamped, self-addressed envelope to: Fort Myers Amateur Radio Club Inc.  P.O. 3) At the event.

Any returned and canceled checks will automatically disqualify the ticket holder from winning the raffle prize.

Selection of Winner:

The Door Prize drawings for the FORT MYERS AMATEUR RADIO CLUB Inc. Door Prizes will be held on Friday JAN 17, 2020 beginning at 1:00pm and ceasing at 0400pm and again on Saturday, JAN 18, 2020 beginning at 09:00am and ceasing at 01:55pm.     TheTop Prize drawings will commence  at approximately 2p.m on Saturday, Jan 18, 2020,  at the HAMFEST conducted at the “Florida SouthWestern State College Bldg. U ” , 8099 College  Parkway, Fort Myers, Fl. 33919  With the exception of this and all other dates stated in these rules, the date may be extended in the FORT MYERS AMATEUR RADIO CLUB Inc.’s absolute discretion. The winners  need to be present to win except for the 3 top prize awards.

General Terms and Conditions:

By participating in this Door Prize Drawing, all admission ticket purchasers and everyone named on a Admission ticket accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here and (2) that their name and/or likeness may be disclosed to and used by the news media and may otherwise be used by FORT MYERS AMATEUR RADIO CLUB Inc. for publicity purposes and the Door Prize winners to be published in area newspapers or other media including television, radio, web and print. The Door Prize winners will be published on FORT MYERS AMATEUR RADIO CLUB Inc.’s Website.   By participating in this Door Prize Drawing, each participant releases FORT MYERS AMATEUR RADIO CLUB Inc. and each of their respective directors, officers, and agents from any and all liability for injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold FORT MYERS AMATEUR RADIO CLUB Inc. and each of their respective directors, officers, and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize. No aditional purchase or contribution is necessary to participate in the Door Prize Drawings

Refunds:

 No  refunds are available.  FORT MYERS AMATEUR RADIO CLUB Inc. assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines.  A raffle participant’s sole and exclusive remedy for FORT MYERS AMATEUR RADIO CLUB Inc.’s breach shall be limited to the return of the amount  paid for his or her admission ticket(s). In no event shall FORT MYERS AMATEUR RADIO CLUB Inc. or their respective directors, officers, members, committee members,  agents, contractors, advisers, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.

DISCLAIMER OF ALL OTHER REPRESENTATIONS and WARRANTIES:

THE DOOR PRIZES WILL BE TRANSFERRED TO THE DOOR PRIZE WINNERS IN “AS IS, WHERE IS” CONDITION BY FORT MYERS AMATEUR RADIO CLUB Inc.      FORT MYERS AMATEUR RADIO CLUB Inc. DOES NOT PROVIDE ANY GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, IN CONNECTION
WITH THE PRIZE.
FORT MYERS AMATEUR RADIO CLUB Inc. ACCEPTS NO LIABILITY OR RESPONSIBILITY REGARDING THE MANUFACTURING OR CONDITION OF THE PRIZE. NO WARRANTIES, EXPRESS OR IMPLIED, ARE MADE OR OFFERED BY FORT MYERS AMATEUR RADIO CLUB Inc. THERE ARE NO REPRESENTATIONS OR WARRANTIES OTHER THAN AS SET FORTH IN THESE OFFICIAL RULES AND REGULATIONS.
FORT MYERS AMATEUR RADIO CLUB Inc. DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE DOOR PRIZES, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.   A DOOR PRIZE DRAWING PARTICIPANT’S SOLE AND EXCLUSIVE REMEDY FOR FORT MYERS AMATEUR RADIO CLUB Inc.’S  BREACH SHALL BE LIMITED TO THE RETURN OF THE AMOUNT PAID FOR HIS OR HER ADMISSION TICKET(S). IN NO EVENT SHALL FORT MYERS AMATEUR RADIO CLUB Inc. BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF FORT MYERS AMATEUR RADIO CLUB Inc.
